The Spokesman of the New Generation Leaders, a Social group Comrade Odede Charles Precious in a statement signed in Yenagoa has called on the good people of Bayelsa State to express calmness over what appears to be a futile attempt aimed at distracting innocent citizens, guaranteeing Bayelsans of a landslide victory at the polls come November 11 and a successful swearing in of His Excellency Chief Timipre Sylva as the Executive Governor of Bayelsa State.
The guarantee is stated owing to a judgement traceable to the People’s Democratic Party and its candidate influencing the high court in Abuja to deny Bayelsans of the rare opportunity of having their preferred candidate come back into creek haven on the 14th of February 2024.
Odede noted that the section 29 and 84 of the 2022 electoral act stipulates that only persons who contested primaries of a political party has the right as backed by law to oppose the qualification of the party’s candidate, therefore rendering the filing by one chief Demesuoyefa Kolomo who is not a member of the All progressive Congress nor an aspirant in the party’s primaries dead on arrival.
Odede went ahead to state that the Section 285 of the 1999 Nigerian constitution encourages any aggrieved party to file an election matter within 14 days of the occurrence of the event but this case was filed on the 13th of June 2023 whereas INEC published the names of the governorship candidates for Bayelsa, IMO and Kogi on the 12th of May 2023. Thus, the case was filed outside the constitutional prescribed 14 days thereby making the case statute barred, expressing how It is surprising that the court ignored the fact that the plaintiff lacked the legal right to sue and went ahead to give judgement in their favour.
Additionally, there is a practice directed by the Supreme Court that all pre-election matters be heard in the state where the primaries took place and to perfect their evil act, they erroneously filed the case in Abuja. Ignoring the red flag that Abuja isn’t Bayelsa.
Odede continued that the group can perceive the plot by Governor Douye Diri to go through the back door which is his usual practice having realized that the preferred governorship candidate Chief Timipre Sylva will emerge victoriously owing to the wide acceptance in the eight local government areas of the state.
Odede concluded by saying it is very certain that the Court of Appeal will overturn the judgement of the Federal High Court, as he encouraged bayelsans not to allow the old strategy by the PDP deter their decision to elect Chief Timipre Sylva as the next Governor of Bayelsa State.
